EXPLICIT CONSENT TEXT FOR THE PROCESSING OF PERSONAL DATA (EMPLOYEE CANDIDATE)

I have read and understood the Information Notice on the Processing of Personal Data prepared by Bien Yapı Ürünleri Sanayi Turizm ve Ticaret Anonim Şirketi (“Bien” or the “Company”) in accordance with the Personal Data Protection Law No. 6698 (“Law” or “KVKK”). Through this Information Notice, I have been informed about the personal data processed, the purposes of processing, the method of collection and the legal basis, the purposes and recipients of data transfers, and my rights arising from the Law as a data subject.

I hereby acknowledge, declare, and undertake that I have obtained the explicit consent of the individuals whose personal data I have provided as references and that I have shared such information with the Company after duly informing them.

I acknowledge and declare that, should I grant explicit consent, I may withdraw my consent at any time without providing any justification.

I give my explicit consent to the retention of my personal data by the Company for a period of 1 (one) year for the purposes of evaluating my application and contacting me in the event that a suitable position arises in the future; to the verification of my references and the conduct of necessary background checks; and to the transfer of my personal data to the Company’s group companies and other companies that have an organic connection with the Company and/or share a similar partnership structure, for the purpose of contacting me regarding my application.

INFORMATION NOTICE FOR EMPLOYEE CANDIDATES ON THE PROCESSING OF PERSONAL DATA

Bien Yapı Ürünleri Sanayi Turizm ve Ticaret Anonim Şirketi (“Bien” or the “Company”) processes personal data within the limits mandated by the Law on the Protection of Personal Data No. 6698 (“Law”), secondary legislation issued under the Law, the decisions of the Personal Data Protection Board, and other applicable legal regulations. This Information Notice has been prepared by the Company, acting in its capacity as Data Controller, in order to inform employee candidates regarding the processing of personal data you have shared with us, pursuant to Article 10 of the Law.

PURPOSE AND LEGAL BASIS OF PROCESSING PERSONAL DATA

Your personal data may be processed for the purposes of evaluating your resume in relation to the relevant position, conducting reference checks, contacting you regarding your job application, carrying out recruitment processes, and implementing our Company’s human resources policy. These activities are based on the data processing conditions stipulated under Article 5(2)(b) of the Law—necessity for the establishment or performance of a contract—and Article 5(2)(f)—necessity for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not harmed.

METHOD OF COLLECTING PERSONAL DATA

Your personal data may be collected through various means, including but not limited to: submitting your resume to our Company in person, sending it via e-mail, completing the application form available on our website, and other written, verbal, electronic, fully or partially automated, or non-automated methods.

PERSONAL DATA TRANSFERS: RECIPIENTS AND PURPOSES

Your personal data may be transferred to our group companies and other companies that have an organic link with our Company and/or share a similar partnership structure, for the purpose of evaluating your job application and contacting you when necessary. Additionally, during the evaluation of your application, where required and upon request, your data may be shared with legally authorized public institutions and organizations for the purposes of fulfilling legal obligations.

RETENTION PERIOD FOR PERSONAL DATA

Your personal data is retained for 1 (one) year to evaluate your application and to contact you in the event that a suitable position arises in the future. If your application is accepted and an employment relationship is established with the Company, your personal data will be transferred to your personnel file, about which you will be informed through the Employee Information Notice.

At the end of the designated retention period, your personal data will be destroyed using methods such as deletion, destruction, or anonymization in accordance with our periodic destruction schedule. You are responsible for informing and obtaining consent from the individuals you provide as references.

YOUR RIGHTS AS A DATA SUBJECT

By applying to our Company, you have the right to: Learn whether your personal data has been processed, Request information regarding such processing if your data has been processed, Learn the purpose of processing your data and whether it is used in accordance with its purpose, Learn the third parties to whom your data is transferred domestically or abroad, Request the correction of incomplete or incorrect personal data and request notification of such correction to third parties to whom the data has been transferred, Request the deletion or destruction of your personal data if the reasons requiring its processing no longer exist, and request notification of such action to third parties to whom your data has been transferred, Object to any outcome against you resulting from the analysis of your personal data exclusively through automated systems, Request compensation if you suffer damages due to the unlawful processing of your personal data.
